Below you can find the terms for using this Platform because they have to be there. If you are like almost everyone you won’t read them. So here is the gist:
You may only use the Platform in accordance with applicable law, the Agreement and any other instructions or terms provided on the Platform (runtrack.run), or otherwise communicated by RUN:TRACK:RUN.
You may not breach, circumvent, delete or affect any technology or security systems used by RUN:TRACK:RUN to protect the Platform and the content on the Platform. Further, you may not act in any manner that could disable, overburden, impair or damage the Platform or act in any other manner that could damage RUN:TRACK:RUN or other users of the Platform.
The Platform may only be used for the intended purpose and in accordance with RUN:TRACK:RUN’s instructions, and these T&C’s. In case of other uses or if the use causes damage to RUN:TRACK:RUN, we are entitled to immediately suspend your access and use of the Platform.
The rights to the content you create and add to the Platform, for example by providing us with written material, creating a new track, trail or race, belong to RUN:TRACK:RUN as long as nothing else is stated by RUN:TRACK:RUN. You are responsible for the accuracy of all the information you add to, or provide for, the Platform.
Texts you supply to RUN:TRACK:RUN in the role of a RUN:TRACK:RUN Ambassador may not be published elsewhere than on the RUN:TRACK:RUN Platform. RUN:TRACK:RUN is not permitted to publish any text provided by our Ambassadors without giving proper credit to the author. RUN:TRACK:RUN may at any point make changes in the written material provided by our Ambassadors without the author's’ prior consent.
You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer or sell for any commercial purposes any portion of the Platform, use of the Platform or access to content. You may not use the Platform, or assist or encourage any other party, to engage in any of the following prohibited activities:
Use of the Platform is free of charge.
RUN:TRACK:RUN is constantly striving to improve the Platform. For that reason, RUN:TRACK:RUN reserves the right to, at any time without accountability and without liability to you, and without the duty to provide you with a prior notice, update, support, upgrade, modify, temporarily or permanently limit or discontinue the Platform or the access to the Platform.
You understand, agree and accept that RUN:TRACK:RUN has no obligation to maintain, support, upgrade or update the Platform, or to provide any specific content through the Platform.
RUN:TRACK:RUN, RUN:TRACK:RUN’s suppliers and/or its licensors holds all rights, including intellectual property rights (including but not limited trademarks, copyright, inventions, patent and source code and functions), on the Platform. You receive a limited, non- exclusive, non-transferable, non-sublicensable, revocable license to use the Platform during the term of the Agreement.
RUN:TRACK:RUN is only responsible for any direct damages caused by RUN:TRACK:RUN’s negligence. You are not entitled to any compensation for any indirect damages, such as loss of profit, third-party damage, loss due to operational failure, loss of data or any other consequential damage, unless RUN:TRACK:RUN has acted with intent or gross negligence or if such liability cannot be limited under applicable law.
This Agreement is valid from the moment you start using our RUN:TRACK:RUN Platform. If you in any way violate these Terms and Conditions, we have the right to terminate the Agreement and deny you access to the Platform.
RUN:TRACK:RUN will not be liable for any damage suffered or incurred by you due to an event outside RUN:TRACK:RUN’s control, such as an enactment, labour dispute, mobilisation, act of terror, war, embargo, rebellion, riots, fires, floods, lightning strike, natural disaster, brake in, hacking, government provision, failure, shortage or delay in energy supply or other equal events. In addition to what is in general considered as an event outside RUN:TRACK:RUN’s control, an event that makes the provision of the Application more expensive or burdensome for RUN:TRACK:RUN compared to the initial conditions shall also be considered as an event outside RUN:TRACK:RUN’s control.
Should any provision in these T&C’s be held invalid or unenforceable for any reason or to any extent, such invalidity or unenforceability shall not in any manner affect the remaining provisions of these T&C’s or mean that any of the remaining provisions of these T&C’s shall be considered invalid or unenforceable and the application of such provision shall be enforced to the extent permitted by law.
These Terms and Conditions and/or the usage of the RUN:TRACK:RUN Platform shall be governed by and interpreted in accordance with Swedish law, without giving effect to any choice or conflict of law provision or rule.
Any eventual legal dispute that arises between RUN:TRACK:RUN and our users, ambassadors, race organizers etc. shall be tried by Stockholms Tingsrätt.
